Rules of Bidding

Teqsports Kft.’s Official Rules of Participation and Bidding at a “Charity Auction” (hereinafter: “Rules of Bidding”).

1. The Auction Organizer. “Charity Auction” (hereinafter: “Auction”) is organized by Teqsports Kft. (registered office: H-1101 Budapest, Expo tér 5-7.; company registration number: 01-09-371772; tax ID number: 28738945-2-42, hereinafter: "Organizer"). Data management and the other tasks related to the implementation of the Auction will be performed by the Organizer as a data controller (hereinafter: "Data Controller"). 

2. Persons Participating in the Auction. The auction is open to everybody who has reached the legal age of adulthood (18 years) and none of the disqualification criteria specified in these Regulations applies to him or her (“Bidder”). The Organizer reserves the right to exclude any person from participation in the Auction and hold him or her liable (seek compensation and possibly motion for prosecution) if a) by manipulating the process of the Auction, hacking the Organizer’s website or otherwise he or she wishes to gain an unfair advantage during the Auction and/or b) misuses other people’s registration data or provides false information.

In order to bid, you only need to give your name (in the case of a legal entity, in addition to the corporate name, the name of the legal representative is also required) and e-mail address. Aware that false statements may result in prosecution, the Bidder declares he or she is in possession of the financial means to pay the price of the bet. The Auction participants have liability for all the consequences of entering incorrect data. As the Organizer is not in a position to verify the accuracy of the data during (or after) participation in the Auction, in each case the related responsibility lies with and all legal and financial consequences must be borne by the person concerned.

The owners and senior executives of the Organizer, their close relatives in the meaning defined in the Civil Code of Hungary, or the owners and senior executives of any other companies directly involved in implementation and their close relatives in the meaning defined in the Civil Code may NOT participate in the Auction.

3. Place and time of the Auction. The Auction will take place on the Organizer's website at www.qatch.org. The subject of the Auction is shown in a picture on the website.

Bidding starts at 12:00 on 24 March, 2021 and runs until 23:59 on 7 April, 2021.

4. Bidding procedure: During the auction, bids for the object put up for auction can be made in a message to the e-mail address [email protected].

The opening bid is HUF 20,000. The bid increment is HUF 5,000.

Bids that are incomplete, illegible, are not received in full due to technical problems or incorrect addressing, or that are no higher than the previous bid or lower than the bid increment will be considered invalid. The Organizer does not assume responsibility for such bids. The Organizer also excludes its responsibility for any constraints or limitations caused to the auction participant by any server breakdown, software malfunction or network failure.

Please note that Bidders are only allowed to make bids up to the amount actually available to them. A bid made at the auction is binding and irrevocable. The person making a valid bid remains bound by his or her bid up to the end of the auction, as due to the nature of the auction service, a binding bid may not be excluded.

The winner of the auction will be notified by e-mail within 72 hours after the end of the auction.

The winner of the auction has 8 working days from the announcement or notification to transfer the amount offered as a donation to the credit of account no. 10403356-33514581 of the Süss Fel Nap Foundation managed by K&H Bank. The purchase price is considered paid when the amount has been credited to the account of the Süss Fel Nap Foundation.

If the winner of the auction fails to fulfil his or her payment obligation by deadline, the Organizer will consider the person offering the next highest amount as the winner.

The object put up for auction will be handed over by the Organizer to the winner, if possible in person, upon receipt of the offered amount to the specified account number. The place and time of the handover will be agreed by the Organizer and the winner.

The Organizer is not to be held accountable for the temporary unavailability of the auction website due to technical reasons during the bidding period. Participants acknowledge that the content, performance, message and data transmission speed of the technical infrastructure of the Auction as well as its response time depend on the server technology applied and may therefore be adversely affected by factors beyond the Organizer’s power, including (but not limited to) connection failures, server computer performance and maintaining a secure network connection. The Organizer excludes any liability arising from the above provisions.

5. Rules of Managing and Reporting Personal Data. These Regulations also qualify as a Custom Privacy Notice. Personal data will be included with the Bidder’s voluntary consent, and the personal data of the winning Bidder will be processed in compliance with the General Data Protection Regulation (GDPR), Act XCII of 2003 on Taxation, Act C of 2000 on Accounting and Act CXVII of 1995 on Personal Income Taxes. By participating in the Auction and approving these Regulations, the Bidder expressly, informedly and voluntarily consents to Teqsports Kft.’s processing of his or her specified personal data or the specified purpose as follows:

a) the Organizer manages the winner’s personal data – his or her name, e-mail address, and the amount of the bid made during the Auction – up to receipt of the winner’s receipt of the auctioned item, and uses it to notify the winner and award the prize; and

b) Photographs may be taken and videos may be shot of the winner during the awarding of the auctioned item; and with consent of the winner of the Auction, these recordings may be displayed on the interfaces and on the websites, social media surfaces and websites of the Organizer and the companies within the Organizer's holding. Simultaneously, the participants in the auction acknowledge that they are not entitled to make any financial claims in relation to these recordings, and they expressly and definitively waive such claims. The Organizer will consult the winner in advance about publication. If the Bidder wishes to withdraw any of his or her above-referenced consents, he or she may submit an application to that effect to the Data Controller.

c) Having contacted the winner, the Data Controller will request and process additional personal data indispensable for the payment and awarding of the auctioned item.

Data management will be terminated on achievement of the purpose and the data will then be deleted.

The Organizer will not disclose this data to third parties in any way. The Bidder may object to the processing of his or her personal data, and if the Organizer finds the data subject's objection justified, the data processing will be terminated and the data will be blocked. If the data subject considers that his or her rights have been infringed in relation to the processing of his or her personal data, he or she may apply to the competent court or request an investigation by the National Authority for Data Protection and Freedom of Information, at:  H-1024 Budapest, Szilágyi Erzsébet fasor 22/C; (website: www.naih.hu; Phone: +36-1- 3911400). Personal data is only accessible to the Data Controller, i.e. the Organizer. In order to implement the bidding and meet the related statutory obligations, the Organizer will manage the following data in relation to the Auction: the Bidder's name, e-mail address, and the last bid price. By participation, the Bidders automatically acknowledge and accept the Rules of Bidding and the Data Management Regulations, and also acknowledge that data reporting is voluntary and data management is based on their voluntary consent and the Bidder consents to data processing by participation in the auction and by the voluntary specification of their personal data. If it becomes necessary to pay taxes, contributions or other public charges in relation to the Auction, the Organizer will manage the additional data necessary for the fulfilment of these obligations, and reporting of such information is considered as a voluntary contribution by the Bidder. The duration of processing the data required for the payment of taxes, contributions or other public charges in relation to the awarding of the auctioned item will be the mandatory data processing period set out in law, and on expiry of this period the data will be deleted. The data will not be disclosed to third parties without prior notice to and consent from the data owner (the Bidder), except in the cases specified by law.

6. Miscellaneous provisions. By participating in this Auction, the Bidder acknowledges that he or she has familiarised himself or herself with the Rules of Bidding and accepts them unconditionally. If the Bidder refuses to accept the Rules of Bidding or any of its provisions, and raises an objection thereto, he or she is not entitled to participate in the Auction and will be automatically excluded from the Auction. In any matter not regulated in the Rules of Bidding, the relevant provisions of the applicable legislation apply.

Any decision made by the Organizer in relation to the Auction is final and binding in every respect, and no legal action may be initiated in relation to them. The Organizer excludes the assertion of claims by auction participants against the Organizer in relation to any decision made by the Organizer during the auction.

The Organizer reserves the right to supplement, revoke or amend these Regulations or the auction without prior notice. The Organizer will publish any changes or cancellations related to the auction on its website. It is the responsibility of the auction participants to be properly informed.

The courts of Hungary have jurisdiction and competence to settle any legal dispute that may arise. Any issues not regulated in this Regulation are governed by the regulations of the Civil Code of Hungary. The provisions of these Regulations, including the terms and conditions of bidding, are valid until further notice.
